Workers' Compensation Law

Franklin Law provides advice, support and representation in the following areas:

  • Claims under the Workplace Safety and Insurance Act ("Workers' Compensation Claims")
  • Reconsiderations and Appeals before the Workplace Safety and Insurance Board ("WSIB")
  • Employee versus Independent Contractor Disputes
  • Appeals to the Workplace Safety and Insurance Appeals Tribunal ("WSIAT")
  • Inadequate Accommodation
  • Judicial Review and Appellate Proceedings

In the early 1900's, governments enacted workers compensation legislation – legislation that was supposed to guarantee that employees who were injured at work would receive compensation. Over one hundred years later many employees still experience difficulty and frustration obtaining the compensation they deserve for the wages they have lost and permanent injuries they have suffered after being injured at work.

Ontario's workers' compensation legislation is called the Workplace Safety and Insurance Act ("the Act"). It is administered by the Workplace Safety and Insurance Board ("the WSIB") and sets out employees' entitlements to a variety of benefits when they are injured at work.

Most workers who seek advice or representation from Franklin Law on workers' compensation matters can benefit greatly from the services and expertise of free-community legal clinics and connecting workers with these resources is typically your best first option. However, Franklin Law is ready and able to support you through every phase of the claims process. In the unfortunate event that your compensation claim has been denied, Ron can help you request that the WSIB reconsider its decision. If reconsideration is unsuccessful, he can represent you in a first-level appeal at the WSIB and if that fails, he can represent you in a second-level appeal at the Workplace Safety and Insurance Appeals Tribunal ("the WSIAT") and further, if necessary.
